Welcome to 3plfinder.io, a digital marketplace that connects Shippers with Third-Party Logistics Providers (3PLs) across the European Union. These Terms and Conditions ("Terms") govern your access to and use of our Platform. By using our services, you agree to these Terms.

1. Definitions

"Platform" means the 3PL Finder Marketplace operated by 3plfinder by Logistics Avenue, available at 3plfinder.io.
"User" means any individual or entity using the Platform, including Shippers and 3PLs.
"Shipper" refers to a business or person seeking logistics services via the Platform.
"3PL" refers to third-party logistics providers offering transport, warehousing, or supply chain services.
"Agreement" means this Terms and Conditions document.

2. Legal Entity & Jurisdiction

This Agreement shall be governed by the laws of Poland, and any disputes shall be subject to the exclusive jurisdiction of the courts in Poland.

3. Eligibility

To use our Platform, you must:

Be at least 18 years old;
Have the legal capacity to enter into binding agreements;
Be operating as a professional, trader, or legal entity (not a consumer under EU law, unless otherwise stated).

4. Platform Functionality

The Platform is an intermediary facilitating introductions between Shippers and 3PLs.
We do not act as a freight broker, freight forwarder, or logistics provider.
Contracts formed between Shippers and 3PLs are direct and independent of 3plfinder.io.

5. User Obligations

Shippers must:

Provide accurate shipment information;
Act in good faith during inquiries and negotiations;
Pay 3PLs as agreed per their own service contracts.

3PLs must:

Provide accurate service offerings and company information;
Comply with all licensing, insurance, and regulatory requirements;
Fulfill services as described.

6. Fees & Payments

The Platform may charge commission or service fees to either Shippers or 3PLs. These will be disclosed transparently prior to transaction.
All billing may be processed via third-party payment providers, and you agree to their terms and conditions.
VAT, if applicable, will be added in accordance with EU tax regulations.

7. GDPR & Data Protection

We are committed to full compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR).

We collect and process personal data only as necessary to provide and improve our services.
Users have the right to access, rectify, or delete their data, and may contact us at contact@logisticsavenue.consulting.

8. Dispute Resolution Between Users

The Platform is not liable for disputes or damages resulting from contracts between Shippers and 3PLs.
We may provide mediation tools or support at our discretion but are not legally obligated to resolve disputes.

9. Reviews and Ratings

Users may leave reviews or feedback on transactions.
Reviews must be honest, non-defamatory, and not violate any applicable laws.
We reserve the right to remove or moderate reviews that breach our guidelines.

10. Prohibited Activities

You may not use the Platform to:

Circumvent fees or conduct off-platform transactions initiated through the Platform;
Post false, misleading, or fraudulent information;
Infringe intellectual property rights or violate data protection laws;
Engage in unlawful conduct under any applicable EU or Member State law.

11. Intellectual Property

All content, trademarks, logos, and software on the Platform are the property of 3plfinder by Logistics Avenue or its licensors.
You may not reproduce, distribute, or create derivative works from the Platform's content without express written consent.

12. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, or consequential damages;
Our total liability under this Agreement is limited to the fees paid by the User to the Platform in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless 3plfinder by Logistics Avenue from any claims, liabilities, damages, or expenses arising out of your breach of this Agreement or misuse of the Platform.

14. Termination and Suspension

We reserve the right to suspend or terminate your access to the Platform at any time, for any reason, including breaches of these Terms or legal obligations.

15. Amendments to Terms

We may update these Terms occasionally. We will notify you of material changes via email or in-app notifications. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

16. Consumer Rights Notice (if applicable)

If you are using the Platform as a consumer under EU law (natural person acting outside your trade or profession), you may have additional rights under applicable consumer protection laws, including the right to withdraw from certain services within 14 days.
